Access to and use of the Site and related services (collectively, the “Services”) are made available to you in accordance with the following terms and conditions and any other rules posted on the Site (collectively, the “Terms and Conditions”). By using the services, such as placing orders on the site,you are agreeing to all of the terms and conditions.
Kenfil Hong Kong Limited is a company registered in Hong Kong SAR. Our registered address is 7/F, Overseas Trust Bank Building, 160 Gloucester Road, Wanchai, Hong Kong.
To use the services you will need to register an HKCloudMart account. In registering an account, you agree to provide information about yourself that is true, accurate, current and complete in all respects. Upon successful registration of your HKCloudMart account, you will also become a member of the HKCloudMart instantly. Therefore, by registering an HKCloudMart account in the site, you agree to be bound by the terms and conditions of the HKCloudMart member programme as well. Please use the same registered email and password to log in to the HKCloudMart website where you can learn more about our privileges and offers.
In using the Site, you agree to accept responsibility for all activities conducted through your account. You are responsible for keeping your account and password secure. If you feel or suspect that the security of your account has been compromised or if there is unauthorized use of your account, please contact us immediately.
2. Product Description
HKCloudMart will endeavor to ensure that the content and the product descriptions on the site to be accurate and complete as possible. We do not warrant that content and product descriptions are accurate, complete, current or error-free. We are unable to return if you feel a product offered by HKCloudMart is not as described.
3. Intellectual Property
All software and content (which is defined as, or includes, any text, audio or music, video, graphics, photographs, and image) are the intellectual property of HKCloudMart and are protected by intellectual property and copyright laws and international treaty provisions. The site is for your personal and non-commercial use only. Any non-personal or commercial use of the content only permitted when expressly authorized by HKCloudMart or its third party licensors. You may not distribute, reproduce, publish, sell or license any content contained within the site without prior consent or authorization of HKCloudMart. Any such unauthorized actions may result in civil consequences or criminal penalties.
HKCloudMart reserves the right to withdraw or amend any item of the services without notice. We will not be liable if for any reason the site is unavailable at any time and for any period.
4. Eligibility to Purchase
In order to place orders with us, you must meet our conditions of eligibility. Be aged 18 years of age or over. Providing personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing information and other requested information as indicated on the Site).
In placing an order with us, you authorize HKCloudMart to process a charge or charges on your debit card in the amount of the total purchase price of your order. You also expressly authorize us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks.
All orders are subject to stock availability and confirmation of the order price. Items in your shopping
basket are not reserved and may be purchased by other customers. The orders are for your personal or company use only. You may not purchase goods from the site for reselling purposes or commercial
5. Pricing and Availability
Prices are shown on the site in Hong Kong Dollars (HKD). Prices displayed on the site at the time your order is accepted will be honoured except in the case of obvious error. Whilst we use our best endeavours to ensure that all prices appearing on the site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled. Excluding HKD the currencies shown on the HKCloudMart are a guideline and we do not guarantee that prices remain accurate to the how you will be charged by your bank.
HKCloudMart attempts to be as accurate as possible. However, hkcloudmark.com does not warrant that product descriptions, prices and details are accurate as errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. Product availability is not guaranteed. If a product is not available when you order processes we will notify you by email.
We accept payments made by bank transaction or a cheque. By placing an order using one of the above payment methods, you confirm that the payment instrument used is yours or that you have been specifically authorized by the owner to use it. If the issuer of your payment instrument refuses to authorize payment to Kenfil Hong Kong Limited, we shall be entitled to refuse to accept your order.
For bank transfer customer, after you have submitted your bank transfer receipt, we will need to verify it with our bank account, once confirmed, your item will be dispatch. We will take all reasonable care to keep the details of your purchase and payment secure, but we will not be liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
7. Acceptance of your Order
When you place an order, you will receive an acknowledgment receipt email to confirm your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until you payment has been approved by us or sign back quotation with authorized signature and company chop.
8. Third Party Content
Third party content may appear on this website or may be accessible via links from this website. HKCloudMart shall not be responsible for and assumes no liability for any infringement, mistakes, misstatements of law, defamation, slander, libel, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of content contained in any third party content appearing on this Web Site. You understand that the information and opinions in the third party content is neither endorsed by nor does it reflect the belief of HKCloudMart.
9. Returns and Exchanges
Unfortunately, once you have placed your order we are unable to amend it. If you would want to changes, you need to contact us as soon as possible. Once we fulfilled the order, you cannot cancel your order for a refund unless it doesn’t work properly.
10. Your Rights
Nothing in the terms and conditions is intended to affect your rights under the Law in Hong Kong SAR.
HKCloudMart shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages that result from the use of, or the inability to use, the materials and services on this website or the performance of its products (even if HKCloudMart has been advised of the possibility of such damages).
We may suspend or terminate your use of the membership at any time, for any reason or for no reason. We reserve the right to change, suspend, or discontinue all or any aspect of the membership at any time without notice.
13. Indemnity and Waiver
At our request, you agree to compensate us fully and hold us, HKCloudMart (including its officers, directors, agents, affiliates, licensors, and suppliers), harmless from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the terms and conditions by you. This includes the use of the site by any other persons using your account caused by your action or inaction.
If you breach the terms and conditions, we take no action against you, it is no wavier for us to exercise our rights and remedies in any other situation where you breach the terms and conditions.
We have our complaints handling procedure that we will use to try to resolve any disputes when they first arise. Please contact us for any order related complaints or comments.
15. Governing Law and Jurisdiction
The terms and conditions is together with all our policies and procedures. It governed by and construed in accordance with Hong Kong SAR law. The relevant courts of Hong Kong SAR will have exclusive jurisdiction in the event of any dispute or claim associated with these teams and conditions.
